Contest Official Rules

1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. CONTEST VOID WHERE PROHIBITED.

2. Eligibility: Dr. Marty Pets Paw Parent Hall of Fame 2022 Contest (the “Contest”) is only open to legal residents of the United States and the District of Columbia EXCLUDING RESIDENTS OF THE STATE OF RHODE ISLAND, who are at least eighteen (18) years of age or older at the time of entry. Proof of residency and age may be required. The winner acknowledges that if they enter the Contest using a fraudulent name or account, they will be disqualified from the Contest. Employees of California Pet Partners, LLC dba Dr. Marty Pets (the “Sponsor”), its affiliated entities, and its advertising and promotional agencies are not eligible to win, nor are members of such employees’ immediate families. The term “immediate families” includes spouses, domestic partners, children, siblings, grandparents, and grandchildren.

3. Agreement to Official Rules: By entering this Contest, the Entrant (“You”) agrees to abide by the Sponsor’s Official Rules and decisions, which are fully and unconditionally binding in all respects. The Sponsor reserves the right to refuse, withdraw, or disqualify any entry at any time at the Sponsor’s sole discretion. By entering this Contest You represent and warrant that You are eligible to participate based on the eligibility requirements set forth above. You also agree to accept the decisions of the Sponsor as final and binding as it relates to the content of this Dr. Marty Pets Paw Parent Hall of Fame 2022 Contest.

4. Contest Period: The nomination period begins at 11:59 p.m. Pacific Time (“PT”) on March 22nd, 2022 and ends at 11:59 p.m. PT on April 5, 2022 (the “Contest Period”). To be eligible for the Contest, nominations must be received within the specified Contest Period.

5. How to Enter: The Contest must be entered by submitting an entry using the online form. The entry must fulfill all Contest requirements, as specified, to be eligible to win a prize.

   As a participant, your entry must fully meet all Contest requirements, as specified in the Official Rules, in order to be eligible to win a prize. Incomplete entries or those that do not adhere to the Official Rules or specifications will be disqualified at the Sponsor’s sole discretion.

6. Winner Selection and Notification: Three (3) winners will be selected by Dr. Marty Pets’ team following the conclusion of the Contest Period. Winner will be contacted by email within five (5) business days following the close of the Contest Period. If any winner cannot be contacted or is disqualified, Sponsor reserves the right, in its sole discretion, to either select an alternate winner or not award that winner’s prize. Sponsor’s decisions regarding all matters related to the administration of the Contest and selection of the winner are final. IF THE WINNER VIOLATES ANY OF THESE OFFICIAL RULES, THE WINNER (AT THE SPONSOR’S SOLE DISCRETION) WILL BE DISQUALIFIED, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY

7. Prize: There will be one (1) grand prize winner and two (2) runners-up. The grand prize winner will receive: $2000 in cash and a $500 donation made in their name to a local animal shelter or pet charity of their choice. Each runner-up will be awarded $500 in cash and a $500 donation made in their name to the local animal shelter or pet charity of their choice. One prize per winner. Each winner is fully responsible for any and all applicable federal, state, and local taxes (including income and withholding taxes). The total prize pool available to be won is $4,500. All prizes awarded are subject to verification of eligibility and compliance with these Official Rules. The prizes are non-transferable and non-assignable, with no cash redemptions or substitutions. Odds of winning depend on the total number of eligible entries received. All three finalists will be honored and highlighted across Dr. Marty Pets’ social media pages @DrMartyPets on Instagram, Twitter, and Facebook. Finalists will be inducted into the Paw Parent Hall of Fame on National Paw Parent Appreciation Day, April 19th, 2022.

8. Rights Granted by You: By submitting an entry (e.g., text, video, photo, etc.) into this Contest, You understand and agree that the Sponsor, any individual acting on the Sponsor’s behalf, and the licensees, successors, and assigns of the Sponsor shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, your submission, name, photo, portrait, voice, likeness, image, statements about the Dr. Marty Pets Paw Parent Hall of Fame 2022 Contest, and your biographical information for advertising, promotional purposes, trade, information, and public relations without any further notice, review, consent, compensation, or remuneration.

9. Release of Liability: By entering the Contest, You release and hold Sponsor, Facebook Inc., and each of their respective parents, subsidiaries, affiliates, directors, managers, members, officers, employees, and agents, harmless from any and all liability for any injuries, losses or damages of any kind arising from or in connection with the Contest, Dr. Marty Pets website or Instagram® feed, or any prize won.

   SPONSOR (INCLUDING ITS PARENTS, AFFILIATES, THIRD PARTY CONTENT PROVIDERS, MERCHANTS, SPONSORS, LICENSORS AND THE LIKE, AND OUR AND THEIR RESPECTIVE DIRECTORS, OFFICERS, MEMBERS, MANAGERS AND EMPLOYEES (COLLECTIVELY, THE “RELATED PARTIES”)) PROVIDES ITS WEBSITE, INSTAGRAM® FEED, PRODUCTS, THIRD PARTY PRODUCTS AND CONTENTS OF ITS WEBSITE ON AN “AS-IS” BASIS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE OPERATION OF THE WEBSITE, OR ITS INFORMATION, CONTENT, PRODUCTS OR THIRD PARTY PRODUCTS. TO THE FULLEST EXTENT PERMITTED BY LAW, SPONSOR AND ITS RELATED PARTIES DISCLAIM ALL SUCH REPRESENTATIONS AND WARRANTIES INCLUDING, FOR EXAMPLE, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

10. Choice of Law: The Contest is governed by the laws of the United States and the State of California, excluding conflicts of laws principles. By entering this Contest, You hereby consent to the exclusive jurisdiction and venue of California courts (state and federal) in Los Angeles County for any causes or controversies arising out of the Contest.

11. Miscellaneous Conditions: The Contest is subject to all applicable federal, state and local laws and regulations, in addition to Instagram®’s Terms of Use. The Contest may only be entered in or from the United States. Contest entries originating from any other jurisdiction will be disqualified. Sponsor has the sole discretion to terminate the Contest at any given time, or to amend these rules at any time for any reason. In the event of an early cancellation, Sponsor reserves the right to award a prize in a random drawing from all eligible entries received before the time of cancellation. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software; or failure of any entry to be received by Sponsor on account of technical problems, cellular or internet service issues, or traffic congestion on the Internet or at any web site; or any combination thereof.
